The French State Council cancels the possibility of transferring data from the GendNotes application to other files


Associations welcome a major step forward for personal data and individual freedoms.

Paris, April 14, 2021 - GendNotes is an application used by the National Police to collect data during its interventions in the field. The State Council ruled yesterday that the decree establishing it did not include any indication of the nature or purpose of the transfers of collected data that could be made to other files, nor of the conditions for their use, and cancelled the possibility of transferring these data. The association and the NGO that lodged the appeal hail this as a major step forward for the protection of individual freedoms.

  • February 20, 2020

The Prime Minister adopted a decree introducing the GendNotes application, presented as a digital version of the gendarmes' notebook. A practical tool that should enable the police to record, transmit and store remarks and information from their daily investigative work.

 

  • May 18, 2020

The association HES, which defends the rights of LGBTI+ people, and the NGO Internet Society France, which defends the rights and freedoms of internet users, are taking the case to the Council State with the assistance of France Charruyer, french attorney. They believe that GendNotes contains several infringements of the legislation in force regarding the purpose, sharing and retention of personal data.
